Wage & Hour Rights and Responsibilities
Wage Payment: Employee rights consist of:- Pay for all earnings made (INFO # 3) at the rate accepted by the company and employee.
– Pay of a minimum of minimum wage (INFO # 1), the suitable Colorado or regional minimum wage, and all earned overtime wages without impermissible deductions from their salaries;.
– Pay of all made earnings without impermissible reductions (INFO # 16).
Labor Statutes, Rules, employment & Published Guidance
Statutes & Rules: DLSS enforces much of Colorado’s wage and hour and other kinds of labor statutes and labor employment guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For employment Equal Work Act. Please check out the Division’s Labor Statutes and Labor Rules webpages for current and employment prior versions of crucial Colorado labor statutes and guidelines.
Published Guidance: The Division’s primary kinds of public guidance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, opinions, and descriptions on numerous labor law subjects; and.
– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.
Written Demands, Complaints, & Investigations
Demands & Complaints for Wages: If a company owes you earnings, you can send your company a written demand for payment of earnings by mail, employment e-mail, text message, or other electronic means. A written need might be sent to the employer at the exact same time a Labor Standards Complaint Form for overdue wages is filed with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, employment and Settlements webpage.
Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and evaluated, a letter explaining the nature of the complaint and the amounts declared to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division may conduct employer-wide direct investigations of prospective infractions of Colorado wage and hour law. If you would like to submit a tip, please email the Division at cdle_di_tips@state.co.us. If you want to submit a specific claim for unsettled earnings, you must fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct examination citation or several Notices of Assessment, employment a supposed company might send a Direct Investigation Appeal Form.
